Terms of Service

1. Acceptance of Terms
By creating an account or using TherapySolo (the "Service"), provided by Divide LLC ("we," "us"), you're agreeing to these Terms. We encourage you to read them carefully. If anything is unclear, please reach out to us before getting started.
2. Medical Disclaimer
IMPORTANT DISCLAIMER
- TherapySolo is a practice management tool, not a medical provider.
- We do not provide medical advice, diagnosis, or treatment.
- As a licensed therapist, all clinical decisions, diagnoses, and treatment plans remain your responsibility.
- Maintaining your professional license and complying with applicable state and federal laws regarding patient care is your responsibility as the treating provider.
3. HIPAA Compliance
When you create an account, a Business Associate Agreement (BAA) is executed between us. Under this agreement, you serve as the "Covered Entity" and we serve as the "Business Associate." As the Covered Entity, obtaining necessary patient consents (including the "Notice of Privacy Practices") before entering patient data into the Service is your responsibility.
4. Subscriptions and Billing
- Fees: The Service is billed on a recurring monthly or annual basis. By subscribing, you authorize us to charge your payment method on file.
- Free Trial: If you start with a free trial, your subscription will begin automatically at the end of the trial period unless you cancel beforehand.
- Cancellation: You can cancel anytime through Settings → Account → "Manage Subscription," which opens your Stripe billing portal. Once cancelled, no further charges will be made. Please note that partial refunds are not available after cancellation.
- Data Export: If you decide to cancel, we recommend exporting your data first using the "Export All Data" tool in Settings → Account.
5. Client Payments (Stripe Connect)
TherapySolo integrates with Stripe so you can collect payments from your clients directly.
- Platform Role: We provide the technology platform, but we are not a bank or payment processor. The payment relationship is between you and your client.
- Disputes: Any refunds or chargebacks are handled directly between you and your clients.
- Fees: Standard Stripe processing fees apply to all transactions.
6. Your Account
- Please keep your login credentials secure and do not share them with others.
- The Service should only be used for lawful purposes related to your therapy practice.
- Any content on your Public Profile should be accurate and professional. We reserve the right to remove content that violates our standards.
7. Templates and Compliance Tools
We may provide templates (e.g., Intake Forms, Good Faith Estimates) to help you get started. These are provided as samples and do not constitute legal advice. Please review and customize them to meet your specific legal and ethical obligations.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERAPYSOLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID TO US IN THE PAST TWELVE (12) MONTHS.
9. Governing Law
These Terms are governed by the laws of the State of Texas.
10. Copyright Infringement (DMCA)
If you believe that content hosted on a TherapySolo public profile infringes on your copyright, please let us know at support@therapysolo.com. We respond to valid takedown notices in accordance with the Digital Millennium Copyright Act (DMCA).
11. Termination
We hope it never comes to this, but we reserve the right to suspend or terminate an account if we believe the Terms have been violated or if the account activity is harmful to other users or third parties.
